Terms of Service

Terms governing the use of the BoilerTech website and the BT Plate application operated by BESNARD CONSULTING SAS.

1. Operator and scope

The BoilerTech website and the BT Plate application (the "Service") are operated by BESNARD CONSULTING SAS, SIREN 882 670 615, RCS Angers, 9 Route des Gaillards, 49250 La Ménitré, France ("BoilerTech"). By creating an account or using the Service you accept these terms on your own behalf and on behalf of the organisation you represent.

2. The Service

The Service lets you connect accounting, banking, email, storage and spreadsheet systems, run data pipelines on the data you load, and produce reports, dashboards and exports. Features may evolve, be added or be withdrawn over time. Some features are provided under a separate written agreement or subscription order, which prevails over these terms in case of conflict.

3. Accounts and security

You must provide accurate information, keep your credentials confidential, enable the security features made available to you and notify us promptly at contact@boilertech.io of any unauthorised use. You are responsible for the actions taken with your account and for the people you invite into your workspaces.

4. Your data and third-party services

You keep all rights on the data you load into the Service. You grant BoilerTech the right to host, process and transform it only to provide the Service to you, as described in our Privacy Policy.

When you connect a third-party service such as Google, Microsoft, Xero, Odoo, Qonto, Wise, Stripe or an accounting platform, you confirm that you are authorised to grant that access and you remain bound by that provider's own terms. Our use of Google user data complies with the Google API Services User Data Policy, including its Limited Use requirements.

5. Acceptable use

You agree not to use the Service to break the law, infringe third-party rights, load malicious code, probe or overload our infrastructure, resell the Service without our written consent, or access data you are not entitled to. We may suspend or terminate access that violates these terms, after notice where reasonably possible.

6. Availability and support

We work to keep the Service available and secure, but we do not guarantee uninterrupted or error-free operation. Maintenance, third-party outages, connectivity issues and events beyond our control may affect availability. Support is provided by email at contact@boilertech.io.

7. No warranty

The Service is provided "as is" and "as available". To the fullest extent permitted by law, BoilerTech disclaims all warranties, express or implied, including fitness for a particular purpose, accuracy of reports and non-infringement. Reports and figures produced by the Service depend on the data and configuration you provide; you remain responsible for reviewing them before relying on them for accounting, tax, legal or investment decisions.

8. Limitation of liability

To the fullest extent permitted by law, BoilerTech is not liable for indirect, incidental, consequential or punitive damages, nor for loss of profit, revenue, data or goodwill, arising from the use of or inability to use the Service. BoilerTech's total aggregate liability for any claim related to the Service is limited to the amount you paid to BoilerTech for the Service in the twelve months preceding the event giving rise to the claim, or to one hundred euros if you paid nothing. Nothing in these terms excludes liability that cannot be excluded under French law, including for gross negligence, wilful misconduct or personal injury.

9. Indemnity

You will indemnify BoilerTech against claims, damages and costs arising from your breach of these terms, from the data you load into the Service, or from third-party authorisations you grant without having the right to do so.

10. Termination

You may stop using the Service and request the deletion of your account at any time. We may terminate or suspend the Service for breach of these terms, for legal reasons or if we discontinue the Service, with reasonable prior notice where possible. After termination, your data is handled as described in the Privacy Policy.

11. Changes

We may update these terms. Material changes are announced in the Service or by email at least 15 days before they take effect. Continued use after that date constitutes acceptance.

12. Governing law and jurisdiction

These terms are governed by French law. Any dispute that cannot be settled amicably is submitted to the competent courts of Angers, France, without prejudice to the mandatory rights of consumers.
